If stealing it allowed you to keep it then even if you got your Smeagle on and said "hah hah I have the Precious! I stole The Precious and it's mine!" the lawyer in me would have said if I lost the item--I mean Idol to theft "no he didn't steal it. I voluntarily let him check it out for awhile but he agreed that it wasn't his but that its still mine." Then the thief would have to say "no I didn't borrow it I stole it and since stealing is fair, it's mine." There would be a stalemate. Even if the theft was caught on tape I could always say I let the person check it out voluntarily and that it wasn't stolen and there would be no way to confirm that or deny it cuz I could always say, oh this conversation happened when the camera wasn't there.

The lawyer in me thought that once you found it it was "yours" according to the game until you formally transferred it according to the rules, whatever those were. I'd be shocked if it was really just a "possession is 90% of the law" deal, where you could just take it and then it's yours. that would lead to alot of wrestling matches I think. For the difference between 50,000- 100,000 Gs (or whatever they make on the jury, I don't actually know) and a million, I could see people doing some pretty wicked stuff to get the Item--I mean Idol. The lawyer in me senses that they couldn't have a workable solution that included the ability to just overpower someone and gangster your way into the final 3.

What if someone said "hey Terry, that shit is dope! let me check that out dude!" then while they were holding it said "hah hah it's mine now!" Does that mean that for those few seconds before Terry kicked that person's ass, that person owns it? It seems weird to think it could be "owned" by whoever happened to be holding it. I mean, stealing it from Terry would be dangerous but what if Sally had it? U could just PWN her (did I use that right?) and it's not like she's gonna kick your ass to take it back so women would be at a disadvantage re the immunity item--I mean Idol if possession was the main issue.

I think I would have buried it somewhere and just made sure i was on record as having it or better yet, I probably would have cut a piece of it off and got it documented on tape that I had the whole thing then just carried around the hair or something. On the other hand, I think they obviously wanted to see the actual item--I mean idol on the show if it was used at TC but if I just pulled out the hair I doubt they would be able to say I didn't have ownership of the whole thing.

I wonder what I would have done with it though. I think that trying to be coy like Terry was at TC about having it (oddly, he said I don't know if he had it) wasn't all that great a move. I would have either said I definitely have it at camp then given to someone I trusted like Nick (this is early on obviously) then made everyone roll the dice on guessing whether I was keeping it or giving it up OR I would have made a better attempt at convincing them I didn't have it and try to get them to think it was safe to vote me out.

Acting like you might have it but might not made it seem like he did have it to me. I would have made it clear I had it to deflect them off to Nick/Austin and then have them get crushed when Nick/Austin broke it out or I would have made it look like I didn't have it and I was scared shitless to draw them in to voting for me then crushing them that way...But what do I know, I was eating Nutella and watching Lost of DVD while all this was going on...

On another note, regarding Misty's original trip to EI (remember that?) I think I wouldn't have been trying to be coy then either. I figure that there's only 2 options, either you have it or you don't but if you say you have it everyone's going to want to see it and if you say you have it but refuse to produce it they'll think you don't have it and resent you for trying to play them. If I came back and they asked me I wouldn't be slick about it. I'd say I don't have it. They'd either think I didn't have it and try to go after me which I couldn't stop anyway if that's what they wanted to do so why make yourself more of a target by being exposed as a liar (i.e. saying you have it when everyone knows you probably dont when you dont show them) or they'd think I was lying and that I really DID have it and might stay away from voting for me. In any event, they wouldn't ask to see it which I think is the issue. That's why I always assumed that you didn't have to actually HAVE the item--I mean Idol in your pocket. What if you lost it in the water at a challenge and it was sitting at the bottom of the water? Could anyone go get it? Who owns it b/w the time you drop it and someone else gets it? I don't know. There's probably some simple rule they just never told us but it's interesting to think about what we would have done..."

Maybe if Stephen the Jew knew about this he wouldn't be getting so excited about stealing Taj's idol that his eyes pop out of his head.
