Each show can set its own terms. It's my understanding that the producers create a fund for each case, probably in the vicinity of the maximum possible verdict for these shows of about $5,000. The verdict is paid from that fund, with the balance (if any) split between the parties.
Someone earlier was asking why would someone bother to defend themselves at all and that answer gives the reason. Say the plaintiff fails to prove their case...then the plaintiff and the defendant get $2,500 each. But if the plaintiff is awarded the full $5,000 then the defendant gets ZERO and looks like an ass on TV.
