Remove this ad My wife got in a tiny little fender bender which put a little scrape on the bumper. The insurance company insists on only paying the repair shop but I want to pocket the cash. Is that wrong?

Say you don't fix it, but then she drives the car into an Arby's or something...you'll get money deducted from your claim for that unfixed/pre exisiting condition. About 15 years ago, some woman smashed into the back of my car when she didn't notice the light had turned red. Her company cut me a check and I kept the money, instead of getting repairs. A few months later, some drunk driving idiot smashed into the back again. That company actually paid for the repairs, so I got the car fixed, plus I got a nice chunk of change.

The point I'm making to him is that HIS own company may want proof that he did the repair before they extend coverage to that part of the vehicle again. (assuming he has "full" coverage"

They vary from state to state and how payments are made and to whom. Second, is there a lien holder? The lien holder is the legal owner and they own a car with no damage. If you take a check to repair the car and pocket the cash you are technically defrauding the lien holder. Check your laws before trying anything that could boomerang on you later.

Rather than fix up the car so I could get $1,000 dollars for it rather than the $700 I did when I eventually traded it in for my first grown up car. Damned if I didnt pocket the cash.

I checked the local laws... ahem... in my area... and they have to pay the owner of the vehicle if they are asked. Turned out they already sent a check to the repair shop. I have no idea why they already did that. They stopped payment on that one and issued us a new one.
